Terms of Service

1. Acceptance of terms

By accessing or using the services provided by RoyalFitApp LLC (referred to throughout these Terms as "KinWise," "KinWisdom," "the Company," "we," "us," or "our"), operated at kinwisdom.com and via the KinWise mobile app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the service. We may update these Terms from time to time and will notify you of material changes by email or through the service. Your continued use after changes take effect constitutes acceptance.

2. The service

KinWise is a private family archive platform where invited family members can record and share stories via text, voice, video, and photo. Access is by invitation only — you must be invited by a Family Historian (administrator) to join a family group. KinWise also offers journal creation tools that compile family stories into downloadable PDFs and professionally printed books.

3. Accounts and eligibility

You must be at least 13 years old to create an account. You are responsible for maintaining the security of your account credentials. Each account is for a single individual and may not be shared, transferred, or resold.

4. Subscriptions and billing

KinWise offers paid subscription plans billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current rate until you cancel.

  • Auto-renewal — subscriptions renew automatically at the end of each billing period. You will be charged the applicable subscription fee unless you cancel before the renewal date.
  • Cancellation — you may cancel your subscription at any time from your account settings or via the Stripe billing portal. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the remaining days of a billing period.
  • Price changes — we may change subscription pricing with at least 30 days' notice. Price changes apply at the next renewal date after the notice period.
  • Gift subscriptions — gift subscriptions are non-refundable once purchased. They activate when the recipient creates an account and expire at the end of the gifted period.

5. Printed books and physical products

KinWise offers professionally printed books through our print-on-demand partner. By placing a print order, you agree to the following:

  • Print-on-demand — each book is custom manufactured to your specifications. Because every book is uniquely produced, print orders are final and non-refundable once submitted for production.
  • No returns or exchanges — due to the custom nature of print-on-demand products, we do not accept returns, exchanges, or cancellations after the order has been placed.
  • Damaged or defective items — if your book arrives with a manufacturing defect (e.g., missing pages, printing errors, physical damage during production), contact us at hello@kinwisdom.com within 14 days of delivery with photos of the defect. We will arrange a replacement at no additional cost. Normal wear from shipping (minor corner bumps, light scuffing) is not considered a defect.
  • Shipping — delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or weather. Risk of loss passes to you upon delivery to the carrier.
  • Pricing — print prices are calculated based on page count, binding type, and finish at the time of checkout. Prices are subject to change without notice, but your order is locked in at the price shown during checkout.

6. Refund policy

Digital subscriptions: Subscription fees are non-refundable. You may cancel at any time to prevent future charges, but no refund will be issued for the current billing period. If you believe you were charged in error, contact us within 7 days at hello@kinwisdom.com.

Printed books: As described in Section 5, print-on-demand products are non-refundable. Replacement is available only for verified manufacturing defects.

Gift purchases: Gift subscriptions are non-refundable once purchased, regardless of whether the recipient has activated the gift.

Chargebacks: If you initiate a chargeback or payment dispute with your bank or credit card company instead of contacting us first, we reserve the right to immediately suspend your account and all associated family accounts until the dispute is resolved. We will provide transaction records, delivery confirmation, and other documentation to dispute the chargeback. Accounts suspended due to chargebacks may not be reinstated. We encourage you to contact us at hello@kinwisdom.com to resolve any billing concerns before initiating a dispute with your financial institution.

7. SMS messaging consent

KinWise sends SMS messages only to users who have given explicit consent by checking the SMS opt-in checkbox during account setup or onboarding. The checkbox is unchecked by default — you must actively select it to receive SMS messages. Providing a phone number alone does not constitute consent to receive SMS messages.

SMS messages from KinWise include family story prompts, family notifications, and service updates. Message frequency is typically 1–2 messages per week. Message and data rates may apply.

To opt out of SMS messages, reply STOP to any message. You will receive one confirmation message and no further SMS will be sent. To re-subscribe, reply START. For help, reply HELP or contact us at hello@kinwisdom.com.

8. Your content

You retain ownership of all stories, recordings, photos, and content you submit. By submitting content, you grant KinWise a limited, non-exclusive license to store, process, transcribe, display, and include your content in generated journals (PDF and print) as part of operating the service for your family group. This license terminates when you delete your content or your account is closed.

You represent that you have the right to submit all content you provide and that your content does not infringe on the rights of any third party.

9. Acceptable use and fair use limits

You agree not to submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or violates the rights of others. The Family Historian is responsible for moderating content within their family group.

To ensure fair access for all users and prevent abuse, KinWise enforces the following reasonable usage limits:

  • Family members — each family group may include a reasonable number of members consistent with a family unit. We reserve the right to limit the number of active members per family.
  • SMS messages — SMS sending is subject to rate limits to prevent abuse and control costs. Excessive or automated messaging may result in throttling or suspension.
  • Storage — media uploads (audio, video, photos) are subject to reasonable storage limits per family. We will notify you before any limit is enforced.
  • Journal generation — journal PDF generation and AI-powered features are subject to reasonable usage limits per billing period.
  • API and automation — automated access, scraping, or programmatic use of the service is prohibited without prior written consent.

We reserve the right to adjust these limits at any time to maintain service quality. Current specific limits are available upon request at hello@kinwisdom.com.

10. Prohibited conduct

In addition to the acceptable use requirements above, the following conduct is strictly prohibited and may result in immediate account termination:

  • Creating accounts or inviting members for the purpose of inflating usage, generating excessive costs, or exploiting the service
  • Using the service to send unsolicited messages (spam) to people who are not genuine family members
  • Attempting to circumvent usage limits, billing controls, or security measures
  • Sharing account credentials or reselling access to the service
  • Submitting content that contains malware, phishing links, or other harmful material
  • Using the service in any manner that could damage, disable, or impair our infrastructure
  • Reverse-engineering, decompiling, or attempting to extract the source code of the service

11. Termination and suspension

By you: You may delete your account at any time from your profile settings. Upon deletion, your personal information will be removed and your contributions will be disassociated from your identity.

By us: We reserve the right to suspend or terminate your account, and any associated family accounts, immediately and without prior notice if we determine, in our sole discretion, that you have:

  • Violated these Terms of Service
  • Engaged in prohibited conduct as described in Section 10
  • Created costs or liabilities for us that are disproportionate to the service provided
  • Initiated a chargeback or payment dispute (as described in Section 6)
  • Used the service in a manner that threatens the security, integrity, or availability of our systems

Effect of termination: Upon termination for cause, we may, at our sole discretion, delete all data associated with your account, including your family archive, media files, generated journals, and all content submitted by members of your family group. We will make reasonable efforts to provide 30 days' notice before data deletion except in cases of egregious abuse, fraud, or security threats, where immediate deletion may be necessary to protect the service and other users.

Cost recovery: If your use of the service results in costs that substantially exceed what is reasonable for a typical family account (e.g., excessive SMS messages, storage abuse, or fraudulent print orders), we reserve the right to recover those costs from you in addition to terminating your account.

No refund of subscription fees will be issued upon termination for violation of these Terms.

12. Intellectual property

The KinWise name, logo, website design, and all related trademarks, service marks, and trade dress are the property of KinWise. You may not use our branding without prior written permission. The service itself, including its software, design, and documentation, is protected by copyright and other intellectual property laws.

13. Disclaimer of warranties

KinWise is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee the accuracy of AI-generated transcriptions, summaries, or journal content.

14. Limitation of liability

To the maximum extent permitted by law, KinWise and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the service, regardless of the theory of liability.

Our total cumulative liability for any claims arising out of or related to these Terms or the service shall not exceed the total subscription fees you paid to us in the twelve (12) months preceding the claim. For clarity, this cap excludes amounts paid for printed books, gift purchases, or any other one-time transactions, which are governed by their respective refund and replacement policies in Sections 5 and 6.

15. Indemnification

You agree to indemnify and hold harmless KinWise and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any rights of another party.

16. Dispute resolution

Any dispute arising out of or relating to these Terms or the service shall first be addressed by contacting us at hello@kinwisdom.com. We will attempt to resolve the dispute informally within 30 days. If the dispute cannot be resolved informally, either party may bring a claim in the state or federal courts located in Washington County, Utah. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or representative proceeding.

17. Governing law

These Terms are governed by and construed in accordance with the laws of the state of Utah, United States, without regard to its conflict of laws provisions.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KinWise regarding the service and supersede all prior agreements and understandings.
